§ 10-38. Exceptions or variances.

  • Special cases may arise in which the literal enforcement of a provision of this chapter may impose an undue and unnecessary hardship. Notwithstanding any such provision to the contrary, the cemetery board, may make such exceptions, suspensions or modifications of any applicable provision of this chapter as the cemetery board deems appropriate. Any such exception, suspension or modification shall not be construed as affecting the general application or intent of the provisions of this chapter. Any such exception and the reasons for it shall be noted in the cemetery records.
